Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services provided by Sonder Wellness, LLC (“Protocol by Sonder,” “we,” “us,” or “our”), including the website at protocolbysonder.com, the Performance Assessment, client dashboard, personalized protocols, and all related services (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Not Medical Advice

Our Services are for informational and educational purposes and do not constitute medical advice, diagnosis, or treatment. Protocol by Sonder provides health optimization assessments, personalized protocols, and wellness recommendations. We are not a medical practice and do not provide medical care.

Where our protocols include prescribed compounds, hormones, or diagnostics, these are prescribed by independent licensed physicians and compounded by licensed pharmacies that we have partnered with. The prescribing physician — not Protocol by Sonder — is responsible for all clinical decisions regarding your prescribed interventions.

You should always consult with a qualified healthcare provider before starting any new supplement, medication, or health protocol. Do not disregard professional medical advice or delay seeking it because of information provided through our Services.

If you are experiencing a medical emergency, call 911 or your local emergency services immediately.

3. Account Registration

To access certain features of our Services, you must create an account using your email address. You are responsible for maintaining the security of your account and for all activities that occur under it. You agree to provide accurate, current, and complete information and to update it as necessary.

4. Services Described

Performance Assessment

A free, self-administered questionnaire that evaluates biological performance across five systems and identifies potential bottlenecks. Results are indicative, not diagnostic.

Protocol One

A paid diagnostic and protocol package that includes comprehensive lab interpretation, a personalized protocol (configuration overview, design rationale, custom formulation), a performance dashboard, and a strategy call. Priced at $2,500 (one-time payment).

Protocol Elite

A premium, done-for-you 90-day performance optimization engagement that includes advanced diagnostics, custom protocol design, weekly check-ins, and direct access to our team. Pricing is discussed during the consultation call.

Wearable Integrations

Optional connections to third-party health devices and apps (such as Oura Ring, Eight Sleep, and MyFitnessPal) by connecting directly to each provider’s API. You authorize us to access health data from connected devices for the purpose of informing your protocol. You may disconnect any integration at any time from your dashboard.

5. Payment and Refund Policy

All payments are processed by Stripe. By making a purchase, you agree to Stripe’s terms of service.

Protocol One guarantee: If your protocol does not reveal at least one root-cause insight that changes how you approach your health, we will refund your investment in full. Refund requests must be submitted within 90 days of receiving your protocol by contacting team@protocolbysonder.com.

Protocol Elite refund policies are discussed and agreed upon during your consultation call and outlined in your client agreement.

6. Health Information and Consent

By using our Services, you consent to the collection, use, and processing of your health information as described in our Privacy Policy. This includes information provided through assessments, intake forms, uploaded documents (lab reports, genetic data, etc.), and data received from connected wearable devices.

You represent that all health information you provide is accurate and complete to the best of your knowledge. Inaccurate or incomplete information may affect the quality of your protocol recommendations.

7. Intellectual Property

All content, assessments, scoring methodologies, protocol frameworks, protocol templates, educational materials, and software comprising our Services are the intellectual property of Sonder Wellness, LLC. You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent.

Your personalized protocol is licensed to you for personal use only. You may share it with your personal healthcare providers but may not redistribute them commercially.

8. Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose.
  • Provide false or misleading information in your assessments or intake forms.
  • Attempt to access other users’ accounts or data.
  • Reverse engineer, decompile, or attempt to extract the source code of our software.
  • Use automated systems (bots, scrapers) to access the Services.
  • Redistribute, resell, or commercially exploit any part of our Services or protocols.

9. Third-Party Services

Our Services integrate with third-party platforms including Stripe (payments), Oura, Eight Sleep, and MyFitnessPal (health data), Calendly (scheduling), and others. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.

10. Limitation of Liability

To the maximum extent permitted by law, Sonder Wellness, LLC and its officers, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, including but not limited to:

  • Health outcomes resulting from following protocol recommendations.
  • Actions taken or not taken based on assessment results.
  • Interactions with third-party providers, physicians, or pharmacies.
  • Loss of data or service interruptions.

Our total liability for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

Our Services are provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that our Services will be uninterrupted, error-free, or that any specific health outcome will result from following a protocol.

12. Termination

You may discontinue use of our Services at any time. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to other users or our business.

Upon termination, your right to access the Services ceases. We may retain your data as described in our Privacy Policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of our Services after changes constitutes acceptance of the revised Terms.
